The Employment Counsel is responsible for the full life cycle of employment matters, reporting to Senior Employment Counsel. This position is the primary legal resource for the People Team to handle day to day employment matters. Other key responsibilities include providing legal guidance on federal and state
employment laws, conducting workplace investigations, managing litigation, representing the company to administrative agencies and collaborating with internal stakeholders.
We are flexible with respect to geographic location, and the ideal candidate will be comfortable working remotely/work from home within the U.S. or from our office in Bethesda, MD, Durham, NC or Austin, TX.
Primary Duties:
- Daily ER and HR Counseling: Serve as the first point of contact for the HR and ER teams, providing timely and practical advice on a wide range of daily employment issues, including hiring, discipline, termination, wage and hour compliance, and leave management.
- Litigation Support: Provide critical support for active litigation matters, including managing discovery processes, document collection and review, and assisting with witness preparation.
- Investigations & Agency Responses: Support or conduct internal investigations into employee complaints. Draft position statements and manage information requests in response to charges from government agencies like the EEOC, NLRB or Department of Labor.
- Document Drafting & Review: Draft, review, and update essential employment-related documents, including offer letters, standard separation agreements, employee handbooks, and company policies.
- Compliance & Training: Assist in developing and delivering training programs for employees and managers on key compliance topics like anti-harassment, wage and hour laws, and proper hiring practices; assist in company-wide policy audits to ensure ongoing compliance with local, state, and federal law.
Minimum Qualifications:
- Juris Doctorate from a top-tier law school and active license to practice in at least one jurisdiction.
- 8+ years legal experience practicing employment law in a law firm or combination of law firm and in-house
- Strong oral and written communication skills.
- Track record of successful negotiations of settlements and resolutions of employment matters.
- Experience partnering with and providing counsel to members of HR department at all levels.
- Sound business judgment.
- Detail oriented, analytical, and adept at solving complex legal problems.
- High degree of professionalism and integrity, with ability to communicate with employees at all levels of the organization and to handle confidential information appropriately.
